Purpose: To inform the report of the Special Rapporteur to the General Assembly on special measures
Background

The Special Rapporteur’s report to the General Assembly will examine and analyse special measures and the adequate advancement of racial or ethnic groups to ensure the equal enjoyment of all human rights, pursuant to Article 1(4) and 2(2) of the Convention on the Elimination of Racial Discrimination.

Objectives

The Special Rapporteur is seeking inputs from stakeholders to inform her report to the 79th session of the General Assembly on special measures.

Key questions

Below are key questions that the Special Rapporteur would appreciate inputs on from stakeholders.

  • Any plans, policies, programmes and preferential regimes at the national and local level in areas such as employment, housing, education, healthcare, culture, and participation in public life that seek to eliminate the persistent disparities in the enjoyment of human rights and fundamental freedoms that affect racial or ethnic minorities or individuals belonging to them. These include those resulting from persistent or structural disparities and de facto inequalities resulting from the circumstances of history.
  • Details about the legislative, executive, administrative, budgetary, or regulatory nature in place to mandate special measures.
  • Examples of steps taken to promote consultation and active and inclusive participation of affected and marginalised communities in the development and implementation of special measures.
  • Information about the use of data, disaggregated by race, colour, descent and ethnic or national origin, gender, socio-economic and cultural status in the planning and evaluation of special measures.
  • Examples of any monitoring and evaluation tools used to monitor and evaluate the application and results of the implementation of special measures, including quantitative and qualitative methods.
  • Any reflections on the impact of implemented special measures on addressing persistent disparities in the enjoyment of human rights and fundamental freedoms.
  • Any reflections on societal attitudes towards special measures, including recent trends and/or changes in perceptions of such initiatives.
  • Lessons learned, both positive and negative, regarding the planning, and implementation of special measures.

Submissions may be posted on the mandate’s website. Should you wish to maintain the confidentiality of your submission, kindly clearly indicate this at the time of your submission. Submissions not marked confidential may be cited within the Special Rapporteur’s report.
