IMM legal framework: Legislative Decree of 25-4-2018 on the publication of the revised text of the Law on the creation and operation of the Raonador del Ciutadà, of June 4, 1998.

Andorra ratified the CRPD on 11 March 2014. Legislative Decree of 25-4-2018 on the publication of the revised text of the Law on the creation and operation of the Citizen's Ombudsman, of June 4, 1998, assigned the mandate to the ombudsperson entity. The person who holds the position of Citizen's Ombudsman is appointed by the Consell General (Parliament) with the favorable vote of two-thirds of its members, in a first ballot. If, on a first ballot, this majority is not reached, the candidate who, on a second ballot, obtains the favorable vote of the absolute majority, will be elected. The term of office of the Citizen's Ombudsman is for a period of six years.

The IMM is an Ombudsperson entity and part of a Monitoring Framework consisting of another entity, Consell General (Parliament), whose functions are to express the mixed and equal representation of the national population and the seven parishes, to represent the Andorran people, to exercise legislative power, to approve the State budget and to promote and control the political action of the Government.

The IMM is also mandated with the following functions:

  • Protecting the rights of persons with disabilities, including by receiving, investigating, and resolving complaints, or by mediating conflicts and monitoring activities and reporting;
  • Monitoring the implementation of the CRPD: It exercises the State's function of independent control as set forth in Article 33, paragraph 2 of the CRPD.

The IMM undertakes/has undertaken the following activities:

  • Evaluating policy, legislative and administrative compliance with the CRPD
  • Offering legal and policy advice to ensure compliance with the CRPD and other relevant international human rights obligations of the State: Informs, assists, and advises people with disabilities of their CRPD rights
  • Receiving and considering complaints or reviewing the outcome of complaints received by the NHRI
  • Promoting the rights of women and girls with disabilities in legislation and policies, including in the disability and gender-equality legislation and programmes
  • Cooperating with other domestic mechanisms, as appropriate, such as the Parliament, the National Preventive Mechanism (NPM), National Human Rights Institutions (NHRI), and Equality Bodies, with the aim to reinforce human rights monitoring and reporting at the national level.

Participation of persons with disabilities in the monitoring process:

In terms of persons with disabilities participating and being involved in the monitoring process, persons with disabilities monitoring their rights may submit findings or allegations of human rights violations to the Independent Monitoring Mechanism.
