Mecanismos nacionales de prevención de la Tortura

Subcomité para la Prevención de la Tortura

El Protocolo Facultativo de la Convención de las Naciones Unidas contra la Tortura (OPCAT) es el instrumento internacional que establece el Subcomité para la Prevención de la Tortura y confía a los órganos nacionales - los Mecanismos Nacionales de Prevención (MNP) - un papel en la aplicación de la Convención, como órganos de monitoreo.

Los MNP tienen el mandato de visitar regularmente los lugares de privación de libertad en su país, tales como comisarías de policía, prisiones y otros centros de detención, hospitales psiquiátricos y cualquier otro lugar en el que no se permita a las personas salir por su propia voluntad. Los MNP también tienen el mandato de hacer recomendaciones a las autoridades nacionales para trabajar con ellas en la prevención de la tortura y los malos tratos y en la mejora de las condiciones de vida en los lugares de privación de libertad, para lo cual tienen un papel clave.

Los MNPs están facultados para desempeñar su mandato de manera eficaz teniendo en cuenta que son órganos independientes a los que los Estados Partes garantizan su independencia funcional así como la independencia de su personal, aseguran que sus expertos tengan las capacidades y conocimientos profesionales requeridos y les proporcionan los recursos necesarios para su adecuado funcionamiento.
